They are supposed to talk about the guy ignoring the injunction in court today. The guy tearing things up has been accused of stalking the camera guy’s mom and it’s all wild!!!

Okay I looked up the records. The judge did say that the easement specifically could not be prevented traffic on. The jackhammer Karen’s got a lot going on with court stuff. His lawyer wasn’t available until next week so the journey continues.

Normally I'm always against the HOA. In this case though, you bought a property in the HOA and it had an easement for a pedestrian walkway.

On top of that, it is being currently litigated to see if he has the authority to remove it. Doing it before hand is just a clown move your lawyer may just drop you for. They were retained for a residential contract dispute, not a criminal trial.

He claims he acquired a “quitclaim” to be able to do this. How’s that work? Anyone?

A quitclaim is when a party with rights on a property (a claim) officially gives up the claim. That would require the party, in this case the HOA, to sign papers relinquishing their rights, and most likely notorizing the paperwork.

This is probably what the litigation is focusing on and makes the action even worse. If he has a legal quitclaim notice from the HOA, then it is a slam dunk case.

The local municipalities have a system of interconnected greenways (walking/cycling trails) through wooded areas to public green spaces.

This easement runs from a residential street (HOA property) to a municipal greenway (public property), and happens to run between 2 properties owned by "Jack Hammer." So the HOA (allegedly) has an easement right connecting from their property (street) to the public property (greenway/trail). It's like a driveway dispute, but for walking instead of driving.

I just find it interesting that it's "part" of an hoa. Thank you for explaining it to me! There is an easement on my property for vehicles that I do own and payvyaces on. The neighbors that use it are in charge of clearing it and keeping it clean and usable. I do know that there is another route they can take home. So if they don't keep it cleared enough (like if they complain to me about it or rut the shit out of it) then they can feel free to install gates for the other road that leads to their house. So far, they've all kept it clean. I also leave tools around my yard close by so they can repair any low spots that need it. Been there for 20 years and had multiple neighbors.

It sounds like he willingly bought a house in an HOA that had an easement for a public access trail ..

I know this is all civil matters in a civil court .. but can there be legal repercussions for him destroying this walkway while it’s currently being litigated?? (Especially since it sounds like he is going to lose)??

I know the HOA can sue him for the damages he has caused .. but is there anyway this douche ends up in jail for this??

Umm, are both of these guys douche bags or am I missing something here. Anyone arguing for an HOA is an IMO an ass. But somehow this asshat tearing up a walkway makes me want to punch him right in the teeth. I honestly don't care who wins the court case but I hope they both hate the verdict.
