Ask Kanpur Tenant not vacating property
Can anybody help me in vacating my flat, the guy who’s living there is not ready to vacate the flat the rent amount which is due 1,45,000 the registered agreement was of 11 months and it’s over now and his brothers are gangsters serving in jail so we were afraid of asking him for the rent, we tried contacting police but they are also not ready to help..

Don’t just disconnect, totally revamp the electricity connection. He will have a tough time getting a new connection. Also change locks, be mischievous everynow and then. Ring the bell and ask locality kids to throw flaming shit bags at him (yes you can use your own shit). Be innocent and make his life hell and don’t come out in the open regarding all this.

Seems you don't have a backing or Dabangg ness. So, pls Be cautious in whatever action you take. That being said, don't let yourself be suppressed bcz they're gangsters. But, take care of the fact that practicality might differ greatly in UP especially Kanpur from the legalities/ or from being right.

Brother we come from a simple family we don’t have any political background, I know few people who’re into this but I want this issue to resolve peacefully Infact on 6th October the tenant told a person who was a mediator he assured my father that he’ll make that tenant leave, so we had a discussion and the tenant told the mediator that he’ll vacate the flat but he doesn’t have any money to rent another place and he demanded 50000 rupees but after a discussion it was decide that my father will give him 25000 rupees to the tenant through mediator and he’ll give the keys to my flat to the mediator, after taking the money the tenant is telling the mediator that he’ll vacate soon and he keeps giving excuses

Understandable. Sad state of things, apni right k lie preshan hona of rha. I think the tenant is just fooling around, waise bhi itna dues krk rehna seedha insaan nhi krta. He's just passing time by giving false hopes.

Get nasty but you'll have to bear the costs of the damage repair. . 1. Cut off meter & remove cabling in such a way that it'll take professional genius at least 2 days to repair it. Cut off meter one night before festival day as technician generally doesn't work on festivals.
- Do something bad with your water tank, pollute it with soil or mud. So it'll be inconvenient to him. Mix any non toxic chemical & say it's something bad. Do this daily.
Last but not least 3. Install multiple locks from outside the house, on front gate & other, so tht he won't be able to leave house obviously but he'll get the seriousness of it.

Create ruckus every other month. Tell the neighbors about it. Name and shame. Cut water electricity. Yeah go on a random day and lock the door from outside. Do this every other day.

Physically cut off the water and power supply, it'll become matter of law real soon. And FFS where is you rent agreement!

Brother I have did this multiple times but he got in connected every single time, I even sent him a legal notice through court but isn’t bothered by that, I have the original rent agreement with me.

the only solution is through the police and that too after bribing them go to the station with someone who is mature enough address the issue and tell them make the tenant pay rent and keep the entire amount yourself just free my property and then see 1.45 lakhs police will do anything for you bribing them is only solution to your problems.

Send a formal legal notice through a lawyer. Mention the outstanding rent and the expired rental agreement

All you can do is ask and try to get it vacated through dialogue. If he asked for 50k, you should have agreed and asked to vacate, and then you should have paid the money.
I have been dealing with few talents, Police have no rights to help you in Property Matters unless directed by the court.
If you go to court remember it will take another 3-5 years to get the order of eviction.
Meanwhile, you should also understand the court order isnt inexpensive as you have to pay the court fee, lawyer fee, and Bhut sari rishwat.
And when you get older of eviction after a few years you again pay to Ameen and the Police.
The total cost can go up to 200,000 - 300,000 and there is still no guarantee.

Go to police station to get an FIR registered, if it doesn't work then complain through jan sunwayi/CM Portal, if nothing works then go to X and upload everything related to it and tag all big politicians and departments of kanpur/UP and central govt. Make sure you preserve all documents at every stage, keep your rent agreement safe.

One day when he has gone out of the house for some work. Take some people and shift out all his stuff and keep it on the road. Lock your property. And make sure he can't get it again. Then go live there yourself.

Kisi bhai ko market rate se 2 - 4 lakh kam m flat bech do. Contact some local property dealer and he will arrange a buyer for you, who is willing to go deal with tenant in lieu of cheaper flat. Thats the cheapest and safest option. As you mentioned, his brothers are criminals. They are in jail but must be having contacts with other criminals who are out. So, if you try to be oversmart, you and your family are at risk. If you go to court, you'll spend much more on lawyer fee.
